What changed in August 2026
On August 5, 2026, a federal judge in the Northern District of Texas ruled in Silencer Shop Foundation v. ATF that the NFA registration rules for suppressors cannot be enforced against the plaintiffs, their members and their customers. Since then, covered buyers have been able to take a suppressor home the same way they buy a rifle: a Form 4473 and a background check at the counter, with no Form 4 and no months-long wait.
Who is covered
The ruling covers members and customers of the groups that brought the case. That includes Gun Owners of America (GOA), the Texas State Rifle Association and the other plaintiff organizations. If you are not a member of one of them, the old Form 4 process still applies to you. At Circle Star, current members of GOA, TSRA or FRAC can buy a suppressor over the counter.

How an over-the-counter suppressor purchase works
- Pick your can. Come in or call. We stock suppressors from Dead Air, SilencerCo, B&T, HUXWRX, Otter Creek Labs, Q, Resilient, Ruger, CMMG, Ambient Arms and Diligent Defense, and we can order other models.
- Confirm your coverage. Members of Gun Owners of America (GOA), the Texas State Rifle Association (TSRA) or the Firearms Regulatory Accountability Coalition (FRAC) qualify. Bring your membership card, member number or a membership email showing your name and address, plus a Texas driver’s license with your current address (and your LTC if you have one). You can also email your membership details ahead of time to nfa@circlestarfirearms.com. If not, you sign up for GOA at the counter and we cover the $25 fee.
- Fill out the Form 4473. Same form and same federal background check as any other gun purchase. You must be 21 or older and legally allowed to own a firearm.
- Take it home. Once the check clears, the suppressor goes home with you.

Short-barreled rifles, shotguns and the Form 4 route
The rules for short-barreled rifles and shotguns are more tangled than suppressors, and buyers who are not covered still file with ATF. We make that part easy: NFA transfers are $100 per item, fingerprints, photos and eForms setup are free at Circle Star, and we can help with your SBR project. Common questions
Is buying a suppressor legal in Texas?
Yes. Texas allows civilians to own suppressors. You still have to follow every other federal and state firearm law.
Do I still need a background check?
Yes. Every purchase at our counter goes through the Form 4473 and the federal background check.
What if the ruling changes?
The government can still appeal, and ATF has not issued final dealer guidance. If anything changes, we will follow the new rules and update this page.
Can I buy a suppressor online and ship it to you?
Call us first. Suppressor transfers between dealers across state lines still follow extra rules, and we will tell you what works for your order. See our FFL transfer page for regular transfers.
